Topic: If a jury consists of twelve jurors, should they all have to agree on verdict. In other words, should the verdict have to be unamious? Explain.
As we all know, in order to reach a verdict the jury must reach a unanimous decision. Many times we have seen this cause problems due to corruption of members of the jury, indecision of members of the jury and incapabilty. I believe this method forces the members of a jury to bend or go against their way of thinking and morals just to come to a decision. I believe that a better alternative would be a 3/4 ruling. With this method you could argue that a majority decision is still required and it would also make corruption and payoffs more difficult for major criminals. I believe it would also benefit the jurors in the manor of allowing them to stay strong in their beliefs and decisions rather than knowing they had to conform in order to come to a decision upon another humans life. I would like to see reform in this area, whether it be by my method or another, to rid the court system of the outdated requirement of a unanimous decision. In current times, it is extremely difficult to find 12 people or more than can come together and have all members agree upon one single thing. In the direction our world is heading our criminal justice system seems to be falling behind in progressive views and values.

A jury has to start with a minimum of six and no more than twelve members, and every juror must contribute to the verdict unless they are excused. Unless both parties specify otherwise, the verdict must be undisputed. All twelve jurors have to reach a decision on the outcome or verdict. If, however, they cannot all decide, the judge may dismiss the jury and order a new jury along with a new trial. On the other hand, if the time comes to tally the votes, it is the leading juror’s job to make sure this is carried out properly. In a civil case, the judge will instruct on how many jurors have to agree in order to render a verdict.
In order for the jury to reach a verdict they must take into account every juror’s view and their explanations behind it. A juror should not be reluctant to shift their minds when there is a decent reason behind it. But every juror must uphold their position except diligently encouraged to alter that opinion by fellow jurors. After a thorough and free dialogue with other jurors, each juror should cast their vote only corresponding to their own moral convictions. All jurors have a duty to consider and vote on every subject to be settled in the case. The judge in a civil case, will let the jury know how to proceed with a verdict. In a criminal case, the votes have to be undisputed by the jurors and they must all agree on each and every issue brought up during the trial, and the judge may also give them directions as well.
It is my opinion that a unanimous verdict must be the standard on all cases. There should be no room for doubt when it can literally stop someone’s life. If a juror has doubts about a case, and there is a valid explanation for it, I think that doubt has entered the room. Sending someone to death row or giving them life with no parole, is such a serious matter that should be considered and reconsidered until there is absolutely no doubt left. Time should not be a factor.
