Black (interestingly enough aperson noted for his defense of civil liberties) wrote the majority (6-3) opinionfor the Korematsu case involving the constitutionality ofFDR’s Presidential order 9066 creating the Japanese internment camps.Despite the fact that this was clearly a violation of Japanese-American civilrights, the court upheld the legality of the internment camps. However,in 2018 the SCOTUS finally overruled the Korematsu case.Chief Justice John Roberts said the presidential order creating theseinternment camps was based on race and was “objectively unlawful andoutside the scope of presidential authority.”A more recent case focused on civil liberties involved theconstitutionality of same sex marriage.
